President Donald Trump has once again proven his ability to outmaneuver the establishment by securing Alina Habba’s appointment as Acting U.S. Attorney for New Jersey—despite an intense effort from liberal judges and Democrats to stop her confirmation.
Habba, once a key legal ally of President Trump, was initially appointed in March for a 120-day interim term. But as her deadline approached, the Democrat-controlled Senate failed to confirm her permanent appointment—intentionally stalling the process, according to many conservative observers.
Federal law states that if the Senate does not act within 120 days, the power to appoint a permanent U.S. Attorney falls to district court judges. However, the same judges blocked Habba’s petition to continue in the role and attempted to replace her with her subordinate, Desiree Leigh Grace, an alleged ally of Obama-era Democrats.

Charlie Kirk, founder of Turning Point USA, pointed the finger at Grace and the judges, claiming they “colluded to undermine President Trump’s pick.” He argued the judges acted with political bias, undermining the democratic process.
House Minority Leader Hakeem Jeffries weighed in, tweeting harsh criticism against Habba, calling her a “political hack” and urging the court to reject her outright. His comments only further exposed the deep partisan divisions behind the fight over the appointment.

Why is that important? Under the Vacancies Reform Act, if a U.S. Attorney position becomes vacant, the First Assistant automatically steps into the role. By making Habba the First Assistant, Trump effectively reinstalled her as Acting U.S. Attorney — completely bypassing the hostile judges.
